Today the Full Federal Court will begin hearing the Australian Competition and Consumer Commission’s (ACCC) appeal in relation to the proceedings it brought against Medibank in 2016.
Medibank defended the proceedings because we believed that our actions were not unlawful.
On Wednesday 30 August 2017, the Federal Court dismissed the proceedings the ACCC brought against Medibank.
The Court found that Medibank had not engaged in misleading and deceptive or unconscionable conduct with respect to the communication of changes made to arrangements with some in-hospital diagnostic service providers in 2014.
The ACCC appealed this decision in September 2017 and the appeal is being heard by the Full Federal Court from Wednesday 16 May to Friday 18 May 2018.
The proceedings relate to events that occurred almost 4 years ago.
