If you have an injury or illness which has been caused by the negligence of a third party, you may be entitled to compensation from that third party.
However, depending on your circumstances, Medibank might not be the right place to go, in order to have your medical expenses covered. Even if you have health insurance with Medibank, there are certain times when you may need to claim compensation from third parties.
In many circumstances, claiming from the correct party may lead to a higher compensation payout. Claiming on your health insurance in the following situations may not be permitted under Medibank's Fund Rules.
Injured at work

Provisional payments
When you make a claim, in its discretion, Medibank may pay provisional benefits, provided you agree to repay these payments in full once your compensation claim is resolved. These provisional benefits are subject to Medibank's normal benefit conditions and assessment rules.
If you have been paid benefits by Medibank for services for which you subsequently receive a compensation payout or damages settlement, you will be required to repay to Medibank the benefits provisionally paid to you, in relation to the subject injury or illness.
